Customer Agreement
Definitions:
In this Agreement the terms will have the following
meaning:
 "Agreement"
means this Agreement, including any schedules or
any amendments hereto.
"Customer"
means a third party that has been authorized to
use the SigMAP Software to access
the Data.
"Data"
means any data gathered, encoded, processed and
made available for distribution by
the Data Suppliers through SigMAP Software.
"Sigma"
means Sigma Explorations Inc.
Warranty
Except as otherwise provided herein there are no
other warranties , express, implied or otherwise
for any items furnished hereunder. Sigma disclaims
any implied warranty of merchantability or fitness
for a particular purpose. In no event shall Sigma
or its affiliates be liable for any incidental,
indirect, special or consequential damages in connection
with or arising out of this agreement or the existence,
furnishing or any use of any product or data product
furnished or licensed by this agreement.
Sigma has no reason to believe that there are any
inaccuracies or defects with the data within the
databases, however, Sigma makes no warranty with
respect to and does not guarantee any database or
data within a database being complete or wholly
accurate or, that any of the SigMAP Software will
function error free without failure or interruption
or, that any or all of the Data will be continuously
available to the Customer or meet the Customer’s
requirements.
Usage of Information
The
assigned userid and password may not be shared with
other persons. It is intended
solely for the usage of the licensee.
The
licensee will not provide or make available to any
3rd party digital files, digital images,
or paper maps showing information obtained from
the database.
The
licensee will not show SigMAP or any SigMAP product
to any seismic broker or seismic brokerage
company representative not employed by Sigma Explorations
Inc.
Violation of Terms of Agreement
Violation
of any of the above terms of agreement may result
in immediate termination of
access to SigMAP.
